Note: Time for Filing an Appeal

If a contractor fails to file an appeal before the board of contract appeals within 90 days of receipt of the contracting officer's decision, all is not lost. A contracting officer's decision may also be appealed by filing a complaint before the United States Court of Federal Claims within twelve (12) months of the receipt of the decision. Once you file a timely appeal before the board or the court, however, you are bound by your selection and you must proceed with your appeal in that forum.
